Privacy policy
How we collect, use, protect and retain your personal information, and the choices you have.
This policy applies to 2742565 Ontario Inc., operating as Payday Loan Direct ("we", "us"), and to paydayloandirect.ca and our store at 129 King St E, Unit 2, Oshawa, ON L1H 1C2. We follow Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and Ontario's Payday Loans Act, 2008.
What we collect
- Identity and contact information: name, date of birth, address, phone number, email, and copies of government-issued identification.
- Employment and income information: employer, pay frequency, paystubs and, where needed, bank statements.
- Banking information: account details from a void cheque or pre-authorized debit form, used to deposit your loan and collect repayment.
- Transaction records: details of gold purchases, loans, money transfers and other services, which we are legally required to keep.
- Website information: the pages you visit and standard technical data (browser, device, IP address). This site does not currently use advertising or analytics cookies; if we add analytics we will update this policy.
Why we collect it
- To verify your identity and income, as Ontario law requires of every licensed payday lender, and to comply with anti-money-laundering and other legal obligations.
- To assess your application, prepare your loan agreement, deposit funds and collect repayment.
- To provide the other services you ask for and give you receipts.
- To prevent fraud and protect you and us.
- To contact you about your application or account.
We collect only what we need for these purposes and we do not sell personal information.
Consent
By submitting an application or using a service you consent to the collection and use described here. You may withdraw consent at any time, subject to legal and contractual limits (for example, we must keep records of completed transactions for the period the law requires). Withdrawing consent may mean we cannot provide a service.
Who we share it with
- Service providers who help us operate, under confidentiality obligations: our online form provider (Tally), our website host, payment and e-Transfer processors, and the money-transfer companies (Western Union, Ria, MoneyGram) or carriers whose services you request. Some providers store data outside Canada, where it is subject to local law.
- Regulators and authorities where the law requires, including Consumer Protection Ontario and FINTRAC.
- Collection agencies, only if a loan is in default and only as permitted by Ontario law.
How we protect it
Information you send through our website travels over encrypted (HTTPS) connections. Documents and records are stored in access-controlled systems and locked premises, available only to staff who need them. No method is perfectly secure; if a breach creates a real risk of significant harm we will notify you and the Privacy Commissioner as the law requires.
Please don't email copies of ID or bank documents. Use the secure application form or bring originals to the store.
How long we keep it
We keep loan and transaction records for the period required by the Payday Loans Act, 2008, anti-money-laundering rules and tax law, then securely destroy them. Information from applications that don't proceed is kept only as long as needed to answer questions about the application.
Your rights
You may ask to see the personal information we hold about you, ask us to correct it, or ask how it has been used or shared. Write to the address below or email info@paydayloandirect.ca; we respond within 30 days. If you're not satisfied, you may complain to the Office of the Privacy Commissioner of Canada.
Third-party content on this site
Our contact and service pages embed a Google Map, and the application page embeds a form from Tally. Those companies may set cookies or collect technical data under their own privacy policies when the content loads. Fonts and all other page assets are served from our own website.
